Newsletter Terms and Conditions

BARVNA SP. Z OO NEWSLETTER SERVICE REGULATIONS

  1. BARVNA Sp. z o. o. with its registered office in Gdynia (hereinafter also referred to as the Service Provider) provides the Newsletter service under the terms and conditions set out in these Regulations.
  2. Newsletter means an electronic distribution service provided by
    BARNA Sp. z o. o. with its registered office in Gdynia, via e-mail, which enables all users to automatically receive periodic content from subsequent editions of the Newsletter containing information about BARVNA products, new products, promotions, competitions, events, and collections. BARVNA Sp. z o. o. services are provided under the terms described in these Regulations.
  3. The Newsletter service may be used by a natural person, a legal person acting through an authorized person, or an organizational unit without legal personality, to which the law grants legal capacity and which has full legal capacity (hereinafter also referred to as the "Service User").
  4. The administrator of personal data provided during registration is
    BARVNA Sp. z o. o. with its registered office in Gdynia, ul. Łużycka 10, NIP 5862407647, REGON 529122788.
  5. Providing your data is required to provide the Newsletter service, and failure to do so will result in the inability to send it. Personal data may be shared with our business partners who act on our behalf and support us in providing the Newsletter service.
  6. Personal data are processed:
  7. in order to provide the Newsletter sending service – the legal basis for processing is the necessity of processing for the performance of the contract (Article 6, paragraph 1, letter b of the GDPR);
  8. in the case of sending marketing content to the User as part of the newsletter – the legal basis for processing, including profiling, is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR) in connection with the consent given to receive the Newsletter;
  9. for analytical and statistical purposes – the legal basis for processing is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR) consisting in conducting analyses of User activity on a given Website in order to improve the functionalities used;
  10. in order to possibly establish and pursue claims or defend against them – the legal basis for processing is the legitimate interest of the Controller (Article 6 paragraph 1 letter f of the GDPR).
  1. The use of the Newsletter service is possible after the Service User completes the following steps:
  1. providing your e-mail address in the appropriate field on the Website, or checking the appropriate checkbox in order to receive commercial information via the appropriate channel;
  2. accepting the provisions of these Regulations (including by clicking on the activation link sent by the Service Provider to the e-mail address provided by the Customer – if such functionality is made available). The Service Provider may also provide other ways of accepting the provisions of the Regulations.
  1. By subscribing to the Newsletter, the Customer consents to BARVNA Sp. z o. o. sending advertisements and commercial information via the Newsletter within the meaning of the Act of 18 July 2002 on the provision of electronic services to the User's e-mail account.
  2. To use the service, you must have a device with Internet access, any web browser, and active and properly configured email.
  3. The Newsletter service is provided for an indefinite period.
  4. The Service Provider does not charge Service Recipients for the provision of the Newsletter service.
  5. The Service Recipient is obliged in particular to:
  1. providing the Service Provider with only true, current and all necessary data of the Service Recipient;
  2. immediately update the data provided to the Service Provider in connection with
    with the conclusion of the Agreement.
  1. The Service User has the right to access their personal data, including requesting a copy, rectification, restriction of processing, or deletion of their data, as well as to unsubscribe from the Newsletter service, transfer their personal data, e.g., to another controller, and file a complaint with the President of the Personal Data Protection Office. Additional information regarding personal data protection is included in the " Privacy Policy " available on the Website.
  2. The Service Recipient may, at any time and without giving any reason, unsubscribe from the Newsletter service (resign from the service), in particular by clicking on the deactivation link contained in each e-mail sent to the Service Recipient as part of the Newsletter service or by clicking on the appropriate button on the Website, the link to which is included in the first message sent to the provided telephone number in connection with registration for the Newsletter service.
  3. The Service Provider may terminate the Agreement with one month's notice in the following cases:
  1. a change in the legal provisions regulating the provision of services by electronic means by the Service Provider, affecting the mutual rights and obligations specified
    in the Agreement,
  2. change in the method of providing services due to technical or technological reasons (in particular updating the technical requirements indicated in these Regulations);
  3. change in the scope or provision of services covered by the Newsletter service.

The Service Provider sends its declaration referred to above to the e-mail address or telephone number provided by the Service User when registering for the Newsletter service.

  1. If a Service User has any concerns about the Newsletter service, they may exercise their right to file a complaint. The Service Provider will respond to the complaint promptly, no later than within 14 days of its submission.
    Complaints related to the provision of the Newsletter service may be submitted by e-mail to the following address: info@barvna.coml or by mail to the Company's registered office address: ul. Łużycka 10, 81-537 Gdynia.
  2. The Newsletter service agreement is subject to Polish law.
  3. The Regulations constitute a standard contract within the meaning of Article 384 § 1 of the Civil Code Act of 23 April 1964 (consolidated text: Journal of Laws of 2020, item 1740, as amended).
  4. These Terms and Conditions are available free of charge at www.barvna.com in a form that allows for the acquisition, reproduction, and recording of these Terms and Conditions through the User's IT system. The content of the "Newsletter" service agreement is recorded, secured, and made available by sending the Customer the email address provided during registration of the concluded agreement.
  5. The Service Provider reserves the right to amend these Terms and Conditions, and will notify Service Users thereof via email. Amendments to the Terms and Conditions will take effect on the date specified along with the notice of amendment, but no earlier than 14 calendar days after the notice of amendments is received.
